Terms & Conditions

Definitions

           i.    ‘The Business’ refers to 7 Degrees West.

           ii.    The Business is based in Scotland UK and subject to the exclusive jurisdiction of Scottish Law.

         iii.    ‘The Client’ refers to the person/business who authorised the booking via a signature on the booking form.

Booking Conditions

         i.    Your chosen itinerary will be reserved on receipt of a completed, signed booking form and 30% deposit payment which is non refundable.

        ii.    Reserved bookings will become confirmed on receipt of the Balance Payment (total cost less deposit paid) due not less than four weeks before the start date of the itinerary.

       iii.    Non payment may result in the booking being re-allocated. In this case all payments except the initial deposit will be refunded.

       iv.    The Business will treat all Client details as confidential and under no circumstances will they be passed on to third parties without the consent of the Client.

Cancellation

         i.    In the event of cancellation by the Client more than four weeks before the published start date of the itinerary any amounts paid, except the initial deposit, will be refunded.

        ii.    In the event of cancellation by the Client within four weeks of the published start date of the itinerary, the Client will be liable for the full cost of the activity and full payment will be due to or retained by The Business.

       iii.    The Business, at their discretion, will consider all individual circumstances resulting in cancellation and if the place can be reallocated, may refund some or all of the Balance Payment or agree a mutually convenient alternative date with the client.

      iv.    In the event of the activity being cancelled by The Business, the liability of The Business will be limited to a refund of payments received from the Client.

      v.    Force Majeure – The Business reserves the right to cancel or curtail the itinerary due to circumstances amounting to Force Majeure – these include, but are not limited to, war, riots, terrorism, fire, weather conditions, strike action, and all similar events beyond the control of The Business.

Amendments To Bookings

       i.    Date changes more than four weeks prior to the commencement date of the itinerary will be considered and may be agreed by mutual consent.

       ii.    Within four weeks of the commencement date of the itinerary any date change will be considered to be a cancellation.

      iii.    The Client will be liable for any costs specific to an activity that are not recoverable following an amendment to a booking. These include, but are not limited to, function rooms, accommodation, travel expenses, catering expenses

Alterations

        i.    All details given on The Business website are provided in good faith, however The Business reserves the right to change, cancel or curtail any advertised activity should circumstances necessitate it.

      ii.    The Business’s representatives, namely the skipper has complete discretion with respect to cancelling, curtailing or altering activities based on current and forecast weather conditions, the practical ability of the client group or the availability of the craft

Safety & Seamanship

      i.    You must be in good physical health

     ii.    The Client agrees to be a considerate participant and to respect the craft, other guests and neighbouring boat users.

    iii.    The Business reserves the right to terminate the Client booking at any time if The Client is in possession of illegal substances or if Client behaviour is unacceptable during the itinerary.

    iv.    The Business reserves the right to temporarily suspend Client involvement in the itinerary if it is suspected that their judgement is impaired by alcohol consumption. 

 Liability

    i.        Sailing, motor cruising and powerboating are dangerous sports. Every effort is made to ensure your safety. No liability is accepted for loss, injury or damage to persons or property during any itinerary.
